Tax Agent Terms of Engagement
Engagement of Sean Spence (Agent Number 26215612) as your Tax Agent
We appreciate your decision to appoint Sean Spence as your tax agent. We aim to act in your best interest consistently and provide the utmost level of professional service. This document outlines the terms of our engagement, and any modifications will require the written consent of both parties.
As your tax agent, Sean Spence, will:
(a) Analyse, discuss, and make recommendations regarding your tax return; and
(b) Prepare and lodge all tax returns for the year ending 2024 and subsequent returns until such time when you opt to switch to another accountant.
Client’s Disclosure and Record-Keeping Obligations: You are legally mandated to maintain comprehensive and accurate records pertaining to your tax affairs. It is your duty to provide us with all information necessary for us to perform our work under this engagement in a timely manner or as requested. This includes providing accurate and complete responses to questions we ask. Late, incomplete, or inaccurate information could significantly impact the services and conclusions.

Client’s Rights and Obligations Under the Taxation Laws: Under Australian taxation laws, taxpayers have certain rights and obligations, including the right to appeal or object to a decision made by the Commissioner, seek a private ruling from the Australian Taxation Office (ATO), and the obligation to lodge returns by the due date. We are obligated to inform you of any specific rights and obligations that arise under Australian taxation laws.

Previous Returns: Our engagement does not include reviewing the accuracy of previous returns submitted by you or a previous tax agent, unless specifically requested and agreed upon.

Quality Review: As a registered tax agent under the Tax Practitioners Board, we are subject to periodic professional practice quality assurance reviews. You consent to your files being part of such a review, unless advised otherwise. This review focuses on our client records, not you as a client, ensuring complete confidentiality.

Tax Practitioners Obligation to Comply with the Law: Our duty to act in your best interest is subject to an overriding obligation to comply with the law. For instance, we cannot lodge an income tax return that we believe to be materially false.

Fees: Our fee arrangement is based on the projected amount of time and the level of staff required to complete the services. If you require a fee estimate before commencement, please contact our office. Our payment terms are strictly cash on delivery (COD). Accounts that remain unsettled may be referred to a debt collection agency.
